I called NY EEOC supervisor Perry Canales right back and left him a long message, summarizing my 2 written and signed workplace disability discrimination complaints against Verizon (that I mailed USPS Express to NY EEOC). My original complaint was signed for at NY EEOC on 11/3/2020.

My original complaint included:

1) My complaint

Although Verizon pays me New York State Workers’ Compensation weekly, Verizon refuses to return me to work with a reasonable accommodation. On 5/19/2020, my union CWA local 1104 (which I’ve paid $40,000 in union dues to since January 1990) notified me that Verizon denied my grievance to return me to work with a reasonable accommodation. Verizon refuses to engage me, my doctor Dr. Lippe, and my union CWA local 1104 in the mandatory ADA interactive process. Just to remind EEOC and Verizon, Verizon paid $20 million to settle the largest workplace disability discrimination lawsuit in history on July 6, 2011. Verizon signed a court order agreeing to accommodate its injured employees.

Through DISCOVERY, NY EEOC can find out:

how many injured employees did Verizon return to work with a reasonable accommodation in 2011 (after signing court order)?

how many injured employees did Verizon return to work with a reasonable accommodation in 2012?

how many injured employees did Verizon return to work with a reasonable accommodation in 2013?

how many injured employees did Verizon return to work with a reasonable accommodation in 2014?

how many injured employees did Verizon return to work with a reasonable accommodation in 2015?

how many injured employees did Verizon return to work with a reasonable accommodation in 2016?

how many injured employees did Verizon return to work with a reasonable accommodation in 2017?

how many injured employees did Verizon return to work with a reasonable accommodation in 2018?

how many injured employees did Verizon return to work with a reasonable accommodation in 2019?

2) my Associate Degree in Telecommunications from NCC,

3) my NYS WCALJudge’s decision (dated 3/28/2013) notifying Verizon that I am classified as having a Permanent Partial Disability and my degree qualifies me to do inside work and outside work at Verizon with restrictions,

4) MetLife Disability unit leader Kathleen D. Pencz’s letters (dated August 6, 2014 and May 24, 2016) notifying me that Verizon says that Verizon could not accommodate my work restrictions.

5) Orlin & Cohen letter (dated May 22, 2015) notifying me that Verizon has never discussed with my doctor Dr. Lippe, or any staff, returning me to work with a reasonable accommodation.

6) CWA local 1104 letter (dated May 19, 2020) notifying me that Verizon denied my grievance and refuses to return me to work with a reasonable accommodation.

7) My most recent weekly New York State Workers’ Compensation payments from Verizon (dated 12/8/2020, 12/1/2020, and 11/24/2020).

8) Verizon paid $20 million to settle the largest workplace disability discrimination lawsuit in history (on July 6, 2020). Verizon signed a court order agreeing to accommodate its injured employees.

9) Americans with Disabilities Act from EEOC site states, “An employer must reassign an injured employee who is no longer able to perform the essential functions of his/her original position (as a reasonable accommodation)

My 2nd complaint included my Associate Degree in Criminal Justice from CSU.

NY EEOC supervisor Perry Canales called me back 2 hours later (at 10:38 AM on 12/10/2020) and said, “we [NY EEOC] do not have your original written complaint or your 2nd written complaint. Someone other than an EEOC employee may have signed for your USPS Express Mail deliveries to NY EEOC. I only have your fax. I will assign your complaint to one of my EEOC investigators. One of my EEOC investigators will call you back.

I waited all day 12/10/2020 and 12/11/2020 and 12/12/20 and 12/13/2020 for one of Perry Canales’ EEOC investigators to call me back but he or she never did.

If you do not find and process my 2 USPS Express Mail deliveries to NY EEOC, then I will notify Congressman Pete King who lives in Seaford and the NY FBI that NY EEOC may have a porch pirate who is stealing federal law enforcement mail.

My mother Florence Cloidt Golden worked for NY FBI. Her brother Joseph Cloidt was the Chief Clerk of the Federal Court in Manhattan.
